Accused Deny Murder Charges In Albert Ojwang Case, DPP Opposes Bail


Six individuals accused of murdering Albert Omondi Ojwang have pleaded not guilty, following the formal approval of charges by the Director of Public Prosecutions (DPP). The plea was entered at the Kibera High Court, with the DPP naming Samson Talaam (OCS of Nairobi Central Police Station), James Mukhwana, Peter Kimani, and three others as the suspects in the alleged murder, which took place between the night of June 7 and 8, 2025, at Central Police Station.

DPP Fights Bail Request
The DPP has strongly contested the accused’s release on bail, arguing that their positions as serving officers present serious risks to the investigation. The court heard that John Gitau, another officer under investigation for a different murder, was in custody at the station during the incident. Talaam was reportedly the station commander, Mukhwana managed the cells during the day, and Kimani was on the night shift.

According to the prosecution, releasing the accused could lead to interference with witnesses and evidence due to their insider knowledge, access to weapons, and influence in the police service. The DPP further warned that public unrest following Ojwang’s death could worsen if the accused were freed, potentially disturbing the peace and undermining public trust in the legal process.

Public Demands Accountability
Ojwang allegedly died after being assaulted while in police custody. The case has triggered widespread public outcry, with increasing calls on social media for Deputy Inspector General of Police Eliud Lagat to be held accountable. Although Lagat has stepped aside and recorded a statement with the Independent Policing Oversight Authority (IPOA), his lawyers have denied any involvement in the incident.
